What is evening shift loading?

Depending on which award applies to your business, the rule around evening shift loading is nuanced. The interpretation for the RLCA award applied in our platform is set out below:

Deputy’s Registered and Licensed Clubs Award includes a pay condition called the evening shift loading. The evening shift loading is triggered when an employee works between 7:00 pm and midnight on a weeknight (the “Evening Shift Loading Window”). If an employee works during the Evening Shift Loading Window, they are entitled to additional pay on top of their base hourly rate for each hour or part of an hour that falls in the Evening Shift Loading Window.



What were the issues identified with the evening shift loading?

The evening shift loading malfunctioned in a very narrow set of circumstances for shifts from 1 July 2019 until 3 November 2020, when it was patched in our platform. Specifically, the evening shift loading did not appear on a timesheet if the employee worked during the Evening Shift Loading Window and their shift continued past midnight. If the employee worked during the Evening Shift Loading Window but the shift ended at or before midnight, the evening shift loading functioned properly.



How much overtime is paid for evening shift loading?

For users of the Registered and Licensed Clubs Award, the evening shift loading was $2.27 per hour or part of an hour worked during the Evening Shift Loading Window.


Example scenarios

Scenario #1: Bob is not a maintenance and horticulture worker. He works a shift from 5:00 pm to 3:00 am on Tuesday, 1 September 2020. The Evening Shift Loading Window is 7:00 pm to midnight, so Bob worked 5 hours during that window (7:00 pm to midnight). Therefore, Bob’s timesheet should have included 5 hours of evening shift loading at $2.27 per hour. However, because Bob’s shift extended beyond midnight, the evening shift loading did not appear on Bob’s timesheet.

Scenario #2: Bob is not a maintenance and horticulture worker. He works a shift from 5:00 pm to midnight on Tuesday, 1 September 2020. The Evening Shift Loading Window is 7:00 pm to midnight, so Bob worked 5 hours during that window (7:00 pm to midnight). Therefore, Bob’s timesheet should have included 5 hours of evening shift loading at $2.27 per hour. Because Bob’s shift ended at midnight, 5 hours of evening shift loading properly appeared on Bob’s timesheet.
