Information on how to enter forms part of the terms of entry (T&Cs). By participating and/or entering into the contest, you agree to be bound by these T&Cs.
Deputy’s referral contest (Contest) is available to any person(s) who meets the criteria as set out in clause 3
Words importing the singular include the plural and vice versa.
Words importing a gender include every other gender.
“Including” and similar expressions are not words of limitation.
Where a word or phrase is defined in these T&Cs, other parts of speech and grammatical forms of that word or phrase have a corresponding meaning.
An expression importing a natural person includes any company, partnership, joint venture, association, corporation or other body corporate and any government agency.
Headings are for references only and do not affect interpretation in any way.
The Promoter is Deputec Pty Ltd ACN 133 632 327 of 35 Richards Avenue, Surry Hills NSW 2010 (Promoter).
Entry is open to individuals who are residents of Australia, New Zealand, USA, Canada and the United Kingdom aged eighteen years or over only (Eligible Entrants). Employees of the Promoter and employees of members of the Promoter’s Advocate Program and Partner Program or any other referral program of the Promoter, and in each case their immediate families, suppliers, associated companies and agencies are ineligible to enter.
The contest commences on 1 August 2017 and closes at midnight 31 December 2017 (Australian Eastern Standard Times) (Contest Period).
To enter, an Eligible Entrant must, during the Promotion Period, register and enter their details in deputy.com/contest. Incomprehensible or incomplete entries will be deemed invalid.
By entering into the Contest, an Eligible Entrant consents to receiving communication from the Promoter and consents to the publication of its name on the Promoter’s website, newsletter and other media.
Upon registration, an Eligible Entrant will be provided with a personalised unique web link to the Promoter’s website (Link) which can be shared with friends, colleagues and family.
The Link will direct its visitors to a personalised landing page for that Eligible Entrant. The Link may contain videos and information about the Promoter and an invitation for a free trial to the Promoter’s services.
HOW IT WORKS
For the purpose of this clause, a Referral is a new subscriber that:
becomes a subscriber of a Paid Subscription (as defined in the Promoter’s Subscription Agreement before the end of the Contest Period;
has not previously been a subscriber of a Paid Subscription and has not been referred to the Promoter by any other person;
is not and none of its related entities are an existing subscriber (whether Paid Subscription or otherwise) of the Promoter at the time of the referral.
Subject to these T&Cs, an Eligible Entrant will receive one credit for each Referral that subscribes to the Promoter’s services through the personalised Link belonging to that Eligible Entrant (Credit).
For the avoidance of doubt, a Referral can only be referred once to the Promoter, in the event that an Eligible Referral is referred to the Promoter by more than one Eligible Entrant, only the Eligible Entrant whose personalised Link was first used by the Referral will be entitled for the Credit. The Promoter reserves the right to determine which Eligible Referral is entitled to the Credit and its decision is final and binding.
For the avoidance of doubt, a referred subscriber that commences a Paid Subscription after the end of the Contest Period does not qualify as a Referral even if such subscriber was introduced to the Promoter by the Eligible Entrant during the Contest Period.
There is no maximum number of Referrals that an Eligible Entrant can refer.
An Eligible Entrant must have at least one (1) Credit to be eligible for the prize and where there is no Eligible Entrant with at least one (1) Credit at the end of the relevant period, no prize will be awarded in respect of that period.
During each calendar month in the Contest Period, the Promoter will award a cash prize of AUD $10,000 to the Eligible Entrant who has accumulated the most Credits during that month (Monthly Prize).
There is a maximum of five (5) winners of the Monthly Prize.
On the conclusion of the Contest, the Promoter will award a bonus prize of AUD $10,000 to the Eligible Entrant who has accumulated the most Credits for the duration of the Contest Period (Bonus Prize).
There is a maximum of one (1) winner of the Bonus Prize.
In the event that there are more than one Eligible Entrant with the same number of Credits, the winning Promoter will be the Promoter whose Referrals have, in aggregate and as at the end of the relevant month of the Context Period (as applicable), the highest number of paid active users in respect of their Paid Subscriptions.
Where the Eligible Entrants with the highest number of referrals in the relevant period also have an equal number of paid active users in aggregate across their Referrals, the Promoter reserves the right at its sole discretion to select the prize winner based on the time when the Referrals were recorded and the winning Eligible Entrant will be the person that first achieved their total number of Referrals determined by reference to the time that the last Referral became a subscriber of a Paid Subscription.
The Promoter’s decision is final and binding. No correspondence will be entertained about the Promoter’s decision.
Winners may not request substitutions of prize winnings. All winners are solely responsible for any and all taxes and/or fees as well as additional costs that may be incurred in association with the prize.
A winner of the Monthly Prize will be notified within four (4) weeks after the relevant month for which the prize relates to. A winner of the Bonus Prize will be notified within four (4) weeks after the conclusion of the Contest Period.
Winners will be notified by email. In the event that the prize notification email is returned as undeliverable or the winner fails to claim or collect the prize at the time stipulated by the Promoter, then the prize will be deemed to be forfeited by the winner and the Promoter reserves the right to award the prize to the next Eligible Entrant and the originals winner will no longer be entitled to the prize.
Should an Eligible Entrant’s contact details change during the Contest Period, it is the Eligible Entrant’s responsibility to notify the Promoter.
A prize is personal to and registered in the name of the Eligible Entrant. The prize is not transferrable, exchangeable or payable in other products or services.
Prizes will be paid by way of cheque. The Promoter will not be responsible for any delay in delivery, damage to or loss in transit of the prize. Please allow up to 28 days from the date of notification for the receipt of your prize.
In consideration of the Promoter awarding the prize to the winner, the winner(s) agree(s) to the use of their name, photograph and disclosure of country of residence on the Promoter’s website, newsletters or other media at the Promoter’s discretion and will co-operate with any other reasonable request by the Promoter relating to any post-winning publicity.
The winner also permits the winner’s words, as recorded, photographed or filmed during the winner’s participation in the prize or otherwise provided to the Promoter to appear in connection with the Promoter or the advertising or marketing, in any media whatsoever throughout the world and the winner will not be entitled to any fee for such use.
The Promoter reserves the right to disregard any Referral or refuse to provide a Credit in respect of a Referral which, at its absolute and absolute discretion, does not qualify as a Referral.
The Promoter reserves the right in its absolute discretion to disqualify any Eligible Entrant that the Promoter believes has breached any of these T&Cs, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the Contest. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
The Promoter’s decision is final and binding. No correspondence will be entertained about the Promoter’s decision.
WARRANTIES AND ACKNOWLEDGEMENT
The Eligible Entrant warrants that:
it is legally able to participate in the Contest in its country of residence;
to the best of its knowledge, all information disclosed to the Promoter is both true and correct;
prior to sending the Link or any correspondence in connection with this Contest, the Eligible Entrant has obtained or will obtain the consent (express or implied) of such recipients for the receipt of communication as required by the Spam Act 2003 (Cth); and
the Referral is known to the Eligible Entrant and has consented to the Referral disclosing his personal information (including without limitation personal information such as names and contact details) to the Promoter.
The Eligible Entrant agrees and acknowledges that:
it is not the Promoter’s or contractor, employee, partner, legal representative, agent, joint venturer or franchisee and nothing in these T&Cs creates any such relationship between it and the Promoter;
it has no right or authority to bind the Promoter, assume or create any obligations for or on behalf of the Promoter or make any disclosures, comments, representations or warranties (Disclosures) for or on behalf of the Promoter;
any Disclosures made by the Eligible Entrants to any third parties is made in its own capacity and the Promoter is in no way associated with any such Disclosures and does not take any responsibility or bears no liability towards any third parties for such Disclosures;
it agrees to indemnify and hold the Promoter harmless in respect of all actions, suits, claims, demands, damages, cost and expenses (including legal costs on a full indemnity basis) in respect of any of the Disclosures or a breach of these T&Cs by the Eligible Entrant;
it participates in the Contest and undertakes such referral activity at its own risk and cost and expenses; and
all entries and any copyright subsisting in the entries become and remain the property of the Promoter.
If for any reason this promotion is not capable of running as planned because of infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or any other causes which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Contest, the Promoter reserves the right in its sole discretion to cancel, terminate, modify or suspend the Contest subject to any written directions under applicable legislation without prior notice or liability to the Eligible Entrants. The Promoter gives no warranty as to the continued availability of the Contest.
The Promoter will not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with the Contest except for any liability, which cannot be excluded by law. The Promoter will not be responsible for any incorrect, inaccurate or incomplete information communicated in the course of or in connection with this Contest if the deficiency is occasioned by any cause outside the reasonable control of the Promoter including without limitation technical malfunctions or failures.
These T&Cs constitute the entire agreement between the Promoter and Eligible Entrants in relation to the Contest. The Contest and this T&Cs are governed by the laws of the State of New South Wales, Australia without regard to the principles of conflicts of law. Eligible Entrants submit to the non-exclusive jurisdiction of the courts of Australia.
